LEASE AGREEMENT

herein referred as tenant, Landlord leases to tenant this apartment for a term of 1 year, to commence on  _____________, 20____.  A new 12 month lease must be signed 30 days prior to current lease ending. If not lease has been signed, tenant is presumed to be moving out. Rent is subject to increases around each April based on utility cost from previous year.

RENT: Tenant agrees to pay, without demand, to Landlord, $_______per month by check or money order, mailed to landlords address, 6849 Mellodora Drive, Orangevale, CA 95662. Rent is due on the 1st of each month. A Late fee of $35 is due if rent is not received within 10 days of the due date. This means your mailed rent must be postmarked within the 10 days. Lease is terminated and you must move out if rents and late fee is not paid within 15 days of the due date.

SECURITY DEPOSIT: Upon execution of this agreement, a security deposit of $400 is required by check or money order. Upon termination of agreement, deposit will be returned without interest if apartment is left in the same condition as when first rented. Deposit is forfeited in the event of lease agreement default.

APPLIANCES:  Apartment is furnished with a clean and working refrigerator, stove and microwave. You must keep them clean.

SMOKE DETECTORS: Outside New York City and in Buffalo, each apartment in a multiple dwelling (three or more apartments) must be equipped by the landlord with at least one smoke detector that is clearly audible in any sleeping area. (Multiple Residence Law §15; Buffalo Code Ch. 395).  Your apartment has been equipped with a smoke detector and carbon monoxide detector in working order. You must replace the battery in each one every year, and check the detectors monthly. It is also recommended that you keep a fire extinguisher in your apartment.

SNOW/ICE DANGER: Falling snow and ice from roofs of buildings. Do not stand, walk or park cars where snow and ice land from roofs. Keep your apartment entryway, walkway and parking area clear of snow and ice during the winter. Caution: Walkways are slippery during winter conditions.  

LOCKS: You are being supplied with one key for the current lock installed. Tenants in multiple dwellings can install and maintain their own locks on their apartment entrance doors in addition to the lock supplied by the landlord. The lock may be no more than three inches in circumference, and tenants must provide their landlord with a duplicate key upon request. The Landlord requires you to provide a duplicate within one week of installing an additional lock. If you lock yourself out of your apartment, please call me. I will have someone come unlock your apartment. However, you will be responsible for a $20 fee that will be charged.

LANDLORDS' DUTY OF REPAIR: Landlords of buildings with three or more apartments must keep the apartments and the buildings' public areas in "good repair". Landlords are required to maintain electrical, plumbing, sanitary, heating, ventilating systems and appliances landlords install, such as refrigerators and stoves in good and safe working order.

TENANTS’ DUTY: Tenants are required to notify landlord of any problems in writing. Contact the Landlord by any means if a problem requires immediate attention.  Failure to notify Landlord of problems that cause more damage do to neglect of the tenant will result in rent increase to recover the cost and possible eviction from premises depending on the extent of damage. Tenant is not allowed to make any alterations of the apartment unless in writing. No personal belongings can be stored in the common (public) areas. Each Tenant is to keep the common area around their apartment clean. No dumping of garbage or furniture is allowed on the premises. One car is allowed on the premises.  However, no non-operating vehicles are allowed to be on the premises. The town does not allow parking on the street. Trash must be taken to the local collection point each Saturday. Tenant will repair or pay to have repaired any damage caused by themselves, an immediate family member or guest visiting. PLUMBING/LEAKS: Each apartment is equipped with shut-off valves. If you have a problem, shut off the water valve (s), then contact the landlord immediately at 916-989-3804or 916-792-8747.

MAIL: The St Regis Falls Post Office is close to your apartment. You can establish a postal box there. No mail is delivered to the apartments.

RIGHT TO PRIVACY: Tenants have the right to privacy within their apartments. A landlord, however, may enter a tenant's apartment with reasonable prior notice, and at a reasonable time: (a) to provide necessary or agreed upon repairs or services; or (b) in accordance with the lease; or (c) to show the apartment to prospective purchasers or tenants. In emergencies, such as fires, the landlord may enter the apartment without the tenant's consent. A landlord may not abuse this limited right of entry or use it to harass a tenant.

HEAT: Heat is included in the rent. Heat must be supplied from October 1 through May 31, to tenants in multiple dwellings if: a) the outdoor temperature falls below 55 degrees Fahrenheit, between 6 A.M. and 10 P.M., each apartment must be heated to a temperature of at least 68 degrees Fahrenheit; (b) the outdoor temperature falls below 40 degrees Fahrenheit, between the hours of 10 P.M. and 6 A.M., each apartment must be heated to a temperature of at least 55 degrees Fahrenheit. (Multiple Dwelling Law § 79)  Tenants, who have access to the thermostats, are required to set the heat at no higher then 69 degrees between 6 A.M. and 10 P.M. and 60 degrees from 10 P.M. and 6 A.M. Apartments that have been identified as being set above that temperature will incur a rent increase to cover the increased cost of fuel.

ELECTRIC/WATER/SEWER: Utilities are included in the Rent. Please be conservative.

PETS: No pets are allowed unless approved in writing. A deposit of an additional month’s rent is required for each pet allowed. Pets must be house-trained. Owner must dispose of their pet’s waste immediately. If pet disturbs neighbors in any way, pet must be removed from premises and will not be allowed back. Forfeit of deposit if pet disturbs neighbors and/or damages property.

EVICTION:  Eviction process will be initiated 15 days after due date of rent. Tenant will owe for the remaining rents of the lease contract, all attorney, processor and court fees, cost of cleaning, cost of moving personal belongings out of apartment, plus any repairs caused by negligence. Tenant will also be charged $150 a month to store personal belongings at North Country Self-Storage, LLC in Malone N.Y. There phone number is 877-864-3612.

APARTMENT SHARING: It is unlawful for a landlord to restrict occupancy of an apartment to the named tenant in the lease or to that tenant and immediate family. When the lease names only one tenant, that tenant may share the apartment with immediate family, one additional occupant and the occupant's dependent children, provided that the tenant or the tenant's spouse occupies the premises as his primary residence.

When the lease names more than one tenant, these tenants may share their apartment with immediate family, and, if one of the tenants named in the lease moves out, that tenant may be replaced with another occupant and the dependent children of the occupant. At least one of the tenants named in the lease or that tenant's spouse must occupy the shared apartment as his or her primary residence.

Tenants must inform their landlords of the name, place and phone number of employer and previous address of any occupant within 30 days after the occupant has moved into the apartment or within 30 days of a landlord's request for this information. If the tenant named in the lease moves out, the remaining occupant has no right to continue in occupancy without the landlord's express consent. Landlords may limit the total number of people living in an apartment to comply with legal overcrowding standards. (Real Property Law §235-f)

Upon moving in, using ruler paper, inspect each room and make notes of condition. Make copies of your inspection results and provide original to Landlord within 30 days after moving in. This inspection will be part of your lease agreement.
